Jury Awards Provost Umphrey Client $1.25 Million in Pennsylvania

Provost Umphrey equity partner, Edward Fisher, wrapped up a jury trial in Jim Thorpe, Pennsylvania on Monday, November 9 with a jury award of $1.25 million.

Provost Umphrey Law Firm, L.L.P. represented the family of Victor Bortz against Blue Mountain. Bortz worked for Livengood Excavators, Inc. Blue Mountain hired Livengood to bring out two large articulating dump trucks and a loader to help Blue Mountian move dirt on a 26% slope on a mountain to widen a ski trail. During the fifth run of the day, Bortz was found at the bottom of a short ravine; Bortz had hit his head while jumping out of the emergency exit and had ultimately been run over by the truck. Bortz suffered severe injuries including a severe head laceration and blunt force trauma, which ultimately caused his death.

"I am very pleased with the outcome of this case. The Bortz family suffered through the devastation of losing a loved one, and I am happy they received justice," says Fisher.

Fisher is licensed to practice law in Texas and Pennsylvania. He primarily represents clients who have been injured in workplace accidents, fires and explosions.
