Andy Tindel is the managing attorney of the Tyler, Texas office of the Provost*Umphrey Law Firm, L.L.P. Andy has been a trial and appellate lawyer since 1985 and is a past Chairman of the Litigation Section of the State Bar of Texas. Andy specializes in the preparation, trial and appeal of a wide variety of commercial damage claims and intellectual property litigation including patent, trademark and copyright infringement claims, trade dress and false advertising suits, unfair competition and trade secrets litigation, corporate governance disputes, securities fraud class actions and other general business and commercial litigation. In addition to his commercial litigation practice, Andy also handles selected catastrophic personal injury cases involving product liability claims, FELA litigation, trucking accidents, wrongful death actions, and general negligence cases in all state and federal courts throughout Texas.
In 2007 the Texas Lawyer named Andy as one of only 4 " Top-Notch" Plaintiff's Personal Injury Trial Lawyers in the State of Texas. Andy has also been recognized by Texas Monthly Magazine for inclusion of Texas Super Lawyers every year since its inception,2003-2008. He routinely provides insight and assistance to out-of-state law firms in court protocol, local rules interpretation and briefing strategy in all areas of complex commercial and intellectual property litigation.
Andy has acted as a counsellor, advisor and local counsel on numerous occasions for major foreign and domestic corporations, small business owners, individuals, inventors and law firms involved in commercial damage cases, securities fraud class actions and intellectual property law litigation pending in the Eastern District of Texas. Andy's role as local counsel varies from assisting lead counsel with preparing for trial to serving as co-counsel with the lead attorneys in the trial of the case and thereafter on appeal. Whatever the needs and requests of the client or retaining counsel, Andy will bring a wealth of legal knowledge and courtroom experience to any legal team engaged in prosecuting or defending major civil litigation in any division of the United States District Court for the Eastern District of Texas.
Andy has enjoyed reading and studying the law since entering law school in 1979. His deep interest in the law led him to develop an appellate law practice as a counterpart to his trial work. In 1992, Andy was certified as a specialist in the field of Civil Appellate Law by the Texas Board of Legal Specialization. Over the years, Andy has prosecuted and defended numerous appeals for both plaintiffs and defendants in the federal appellate courts as well as the various Texas Courts of Appeal and the Texas Supreme Court. He has appeared before the United States Court of Appeals for the Fifth Circuit in New Orleans over a dozen times, including arguing and winning two en banc appeals to the full court, Bartley v. Euclid, 180 F.3d 175 (5th Cir. 1998) and Coggin v. Longview I.S.D., 337 F.3d 459 (5th Cir. 2003).
